Terms of Service

1. Acceptance of Terms

By creating an account or using the HarvestTrack web application or website at harvesttrack.ca ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and HarvestTrack ("we", "our", or "us"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

HarvestTrack is a cloud-based harvest tracking and farm management application. It allows farm operators and their teams to log harvest entries, track yield and cull, manage payroll, and generate reports. The Service is currently in beta and is provided free of charge during the beta period.

3. Eligibility

You must be at least 16 years of age to use the Service. By using HarvestTrack, you represent that you meet this requirement. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@harvesttrack.ca if you suspect unauthorized access to your account.

You agree to provide accurate and complete information when creating your account and to keep that information up to date.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable federal, provincial, or local laws or regulations.
  • Upload, transmit, or store any content that is unlawful, harmful, fraudulent, or abusive.
  • Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to store or transmit personal information of employees without their knowledge or in violation of applicable privacy laws.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.

6. Your Data

You retain ownership of all farm data, harvest records, and other content you enter into HarvestTrack ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

You are responsible for ensuring that any personal information you enter about your employees (such as names and email addresses) is collected and used in compliance with applicable privacy laws, and that affected individuals have been informed appropriately.

7. Beta Service

HarvestTrack is currently offered as a beta service. This means the Service may contain bugs, experience downtime, or undergo significant changes. We make no guarantees about uptime, data retention, or feature availability during the beta period.

We may modify, suspend, or discontinue any part of the Service at any time without notice. We will make reasonable efforts to notify users of significant changes via email or in-app notification.

8. Intellectual Property

The HarvestTrack name, logo, software, design, and all related materials are the intellectual property of HarvestTrack. Nothing in these Terms grants you any right to use our trademarks, trade names, or other intellectual property without our prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that any data will be preserved without loss.

10. Limitation of Liability

To the maximum extent permitted by applicable law, HarvestTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which, during the free beta period, is zero).

11. Termination

You may stop using the Service and request account deletion at any time by contacting us at info@harvesttrack.ca.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if it is necessary to protect the Service or other users.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of British Columbia.
